What significance do we want to attach to values such as cooperative self-help, administrative self-sufficiency, freedom, equality or democracy in relation to our autonomous lifestyle as one of many indivduals? Anyone who wants to interpret this philosophical question in legal terms has to take a look at corporate law and, indirectly, to constitutional law. For corporate law regulates the legal ability within our corporate forms. Constitutional law specifies, in turn, a minimum as well as an excess of regulation. The eG is an exceptional corporate form and its concept is strongly oriented towards the values mentioned above. This reveals a glance at § 1 GenG, according to which the promotion of the members via cooperational self-help is anchored as a legally manifested purpose. This foundational principle as well as other essences of the eG are in danger of being abolished or softened beyond recognition against the backdrop of a predominantly capital-economy oriented pressure to adapt. In this paper, the author discusses the special characteristics of the eG in comparison to other german national legal forms, whether and to what extent the legislature is empowered to change its nature, and what enjoys or should enjoy constitutional protection.
