In Europe, as elsewhere, the question of whether and to what extent liability is strict or based on fault remains often answered in uncertain terms. In the light of twelve reports from different Euro-pean jurisdictions, the present volume offers case studies covering among others liability of parents, of employers, of property owners, medical liability, product liability, and motorist liability. Achieving an unprecedented synthesis, this book should not only be of interest to those who work on European law reform projects, but also to those who practice private tort law and seek a better understanding of the foundations of liability, both on a national and an international level.

Franz Werro
Le professeur Franz Werro partage sa vie entre la Faculté de droit de Fribourg et le Georgetown University Law Center à Washington, DC. Pendant dix ans, il a coédité le American Journal of Comparative Law. Depuis 2020, il assume la présidence du Conseil de l’Institut suisse de droit comparé. À Fribourg, il enseigne le droit de la responsabilité civile et le droit des contrats ainsi qu’une introduction au droit privé européen. Par ailleurs, il est chargé de cours à Unidistance et, pendant plus de trente ans, il a été professeur invité à l’EPFL. Il a publié de nombreux articles et chapitres en droit suisse des obligations et en droit comparé. Il est l’un des éditeurs scientifiques du Commentaire romand du droit des obligations. En outre, le professeur Werro fonctionne régulièrement comme expert de droit suisse dans des procédures judiciaires et arbitrales en Suisse et aux États-Unis.
