Foreign investors and African host states would agree that the safety of investments in Africa is anchored in the country’s legal system. Yet, the land grab phenomenon demonstrates that African countries’ legal systems are still in want of reforms - to boost investor confidence while promoting respect for human rights and legitimate tenure right holders’ interests. The study interrogates legal approaches in dispute resolutions in the realm of agricultural land investments. It argues that the proposed UNIDROIT Guide on agricultural land investment contracts is the panacea to encouraging agricultural land investments yet still protecting all stakeholders’ interests including those of legitimate tenure right holders.
