Gesetze sind nur eine von mehreren Grundlagen für die Konstruktion konkreter Sollensurteile. Nach einer funktional-legitimatorischen Normentheorie besteht eine Norm aus ihrem »Tatbestand« und ihrer »Rechtsfolge«. Damit die Rechtsfolgeanordnung eingreift, müssen deren Geltungsbedingungen insgesamt erfüllt sein. Die dafür notwendigen materiellen Begründungselemente liefert der freiheitliche Rechtsstaat. Das Leistungspotential des Konzepts offenbart sich in sämtlichen Teilbereichen des Strafrechts.

As well a Contribution to the Theory of Criminal Legislation«: Laws are merely one of several foundations for the formulation of specific normative judgements. In a theory of norms based on functional legitimacy, a norm consists of its ›factual basis‹ and its ›legal consequence‹. For the prescribed legal consequence to take effect, the conditions for its validity must be fulfilled in their entirety. The required elements of justification are provided by the liberal constitutional state. The effectiveness of this concept is demonstrated across all areas of criminal law.
