Die Arbeit befasst sich mit dem umstrittenen Werbeverbot für Schwangerschaftsabbrüche gemäß § 219a StGB a.F., das grob anstößige Werbung und sachliche Informationen über erlaubte Schwangerschaftsabbrüche unter Strafe stellte. Sie untersucht die Verfassungsmäßigkeit des strafbewehrten Verbots auf Grundlage einer legitimatorisch ausgerichteten Normentheorie und zeigt auf, welche strafrechtshistorischen und kriminalpolitischen Erkenntnisse sich daraus für künftige Strafgesetzgebung gewinnen lassen.

It analyses the constitutionality of this criminal provision on the basis of a normative theory and identifies historical and criminal policy insights that can be derived from it for future criminal legislation.
