Die Arbeit beleuchtet die dogmatischen Unschärfen des § 63 Abs. 1 Nr. 4 ZAG und ordnet dabei dessen Deliktscharakter sowie die Tathandlung des Erbringens ein, um die strafrechtliche Verantwortlichkeit der Hawaladare und deren Kunden zu bestimmen. Zudem werden die Hawala-Netzwerke als kriminelle Vereinigung rechtlich qualifiziert und das Zusammenspiel zwischen § 129 StGB und § 63 Abs. 1 Nr. 4 ZAG als Bezugstat analysiert.
»The Criminal Liability of Hawala-Banking Under German Law. An Examination of the Criminal Nature of Section 63(1) No. 4 of the German Payment Services Supervision Act (ZAG) and its Interaction with Section 129(1) of the German Criminal Code (StGB)«: This thesis examines the criminal liability arising from hawala banking under German criminal law, with a particular focus on the responsibility of hawala operators and their customers. It further analyzes the criminal nature of Section 63(1) No. 4 of the German Payment Services Supervision Act (ZAG) and classifies hawala networks as criminal organizations within the meaning of Section 129(1) of the German Criminal Code (StGB).
