Ziviler Ungehorsam und rechtfertigender Klimanotstand

Kann disruptiver Klimaprotest gemäß § 34 StGB gerechtfertigt sein? Unter kritischer Würdigung der bisherigen Rechtsauslegung zeigt die Arbeit auf, inwieweit klimaaktivistischer Ungehorsam gerechtfertigt sein kann. Zentral für die Ergebnisfindung sind klimawissenschaftliche Erkenntnisse und die Auswertung empirischer Protestforschung. Die sich aus der Angemessenheit ergebenden normativen Grenzen werden im Lichte demokratischer Prinzipien und staatlicher Klimaschutzdefizite eingeordnet.

On the justifiability of law violations motivated by climate activism under Section 34 of the German Criminal Code (StGB), with particular focus on the concepts of necessity and appropriateness«: Can disruptive climate protest action be justified under Section 34 of the German Criminal Code (StGB)? Based on a critical assessment of previous legal interpretations, this thesis explores whether climate activist disobedience can be justified. Scientific findings on climate change and the evaluation of empirical protest research are integral to the analysis. The normative limits resulting from appropriateness are examined in the context of democratic principles and state climate protection deficits.
