Dezentrale Autonome Organisationen (DAOs)

Beschreibung

Die Arbeit behandelt die Herausforderungen des Kollisionsrechts und der Vorschriften über die internationale Zuständigkeit im Zusammenhang mit der Pseudonymität von DAO-Gesellschaftern und der Dezentralität von DAOs. Als zwei Lösungsmöglichkeiten werden die Anknüpfung an das Recht des Programmcodes einer DAO und den Bräuchen ihrer Netzwerkteilnehmer (sog. lex cryptographica) und die blockchain-interne Streitbeilegung in Form von sog. Blockchain Arbitration Verfahren in den Blick genommen.
»Decentralized Autonomous Organizations (DAOs). International jurisdiction, conflict of laws, ›lex cryptographica‹ and Blockchain Arbitration«: The thesis addresses the challenges of conflict of laws and international jurisdiction in connection with the pseudonymity of DAO members and the decentralization of DAOs. Two potential solutions are considered: the law of the blockchain’s code and the practices of its network participants (so-called lex cryptographica), and blockchain-internal dispute resolution through Blockchain Arbitration procedures.
