Der bislang wenig untersuchte Tatbestand des § 271 StGB begegnet insbesondere in Bezug auf Art. 103 Abs. 2 GG erheblichen rechtlichen Bedenken. Die Arbeit prüft die Bestimmtheit des § 271 StGB, ordnet die Norm als Blankett-Straftatbestand ein und zeigt die verfassungsrechtlichen Grenzen auf, innerhalb derer § 271 StGB (noch) bestimmt ist. Zugleich werden Kriterien herausgearbeitet, die § 271 StGB bestimmbar machen und einen verfassungskonformen Umgang mit der Vorschrift in der Praxis ermöglichen.
»Section 271 of the German Criminal Code and the Principle of Legal Certainty«: The rarely examined offense of Section 271 of the German Criminal Code (StGB) raises considerable legal concerns, particularly with regard to Article 103 (2) of the German Constitution. This dissertation examines Section 271 StGB and identifies the constitutional limits within which Section 271 StGB is (still) determinate. Moreover, criteria are developed that allow to apply the provision in practice in accordance with the constitution.
