Die Arbeit befasst sich mit der Frage, ob der medizinische Standard als Maßstab ärztlicher Sorgfalt angesichts digitaler Transformationsprozesse, insbesondere durch den Einsatz Künstlicher Intelligenz, fortzuentwickeln ist. Sie kommt zu dem Ergebnis, dass zwar grundlegende (straf-)rechtliche Prinzipien Bestand haben, jedoch eine Anpassung der Standardkonzeption erforderlich ist. Vorgeschlagen wird ein »datenbasierter Standard« unter Wahrung der Bedürfnisse der Patient:innen.
»Medical Standard and Digital Transformation in Criminal Medical Law. Criminal Law Reception of the Medical Standard and the Impact of New Technologies on the Benchmark for Medical Decision-Making – From the ›Classical Standard‹ to a ›data-based standard‹?«: The thesis explores whether the medical standard, as a benchmark for the duty of care in medicine, requires further development in light of digital transformation processes, particularly the use of artificial intelligence. It concludes that while fundamental (criminal) legal principles remain in place, an adaptation of the standard concept is necessary. A ›data-based standard‹ is proposed, one that also respects and incorporates patients’ needs.
