Beschreibung

Im Zuge zahlreicher technologischer Entwicklungen ist es dem Staat zunehmend möglich, komplexe algorithmische Entscheidungssysteme einzusetzen. Ausgehend von einer kritischen Betrachtung des juristischen Verständnisses von Entscheidungen wird zur Ermöglichung einer analytischen De- und Rekonstruktion der sich wandelnden staatlich-exekutiven Entscheidungsgebilde zum Ziel effektiver rechtsstaatlicher Kontrolle die interdisziplinär informierte, ›deskriptive Systematik der Entscheidungsarchitektur‹ eingeführt.
»Legal protection through decision architectures«: In the course of numerous technological developments, it is increasingly possible for the state to use complex algorithmic decision-making systems. Based on a critical examination of the legal understanding of decisions, the interdisciplinary informed, ›descriptive methodology of decision architecture‹ is introduced to enable an analytical de- and reconstruction of the state's transforming decision-making structures with the objective of guarantee effective constitutional control.
