Episcopus emeritus Ecclesiae Romanae.

Beschreibung

Ausgehend vom Beispiel Papst Benedikts XVI. wird der päpstliche Amtsverzicht analysiert, wobei die lehramtliche Grundlegung, das Primatsverständnis Ratzingers/Benedikts XVI. sowie die kirchenrechtshistorische Genese der heute geltenden Rechtsnorm zum Amtsverzicht sowie diese selbst (c. 332 § 2 CIC/1983) Berücksichtigung finden. Es wird die Notwendigkeit einer eigenen kirchenrechtlichen Weisung bezüglich des päpstlichen Amtsverzichts aufgezeigt und wesentliche Inhalte als Desiderat vorgestellt.

A Canonical and Legal-Historical Investigation of the Papal Resignation with Special Reference to the Resignation of Pope Benedict XVI.«:Based on the example of Pope Benedict XVI. the papal resignation is analysed, whereby the doctrinal foundation, the understanding of the primacy of Ratzinger/Benedict XVI. as well as the canon law-historical genesis of the current legal norm for resignation as well as this itself (c. 332 § 2 CIC/1983) are taken into account. The need for a separate canonical directive regarding the papal resignation is shown and essential content is presented as a desideratum.
