Die absolute Vorrangregel zählt zu den wichtigsten Regeln des deutschen und amerikanischen Restrukturierungsrechts. Dieser Status wird durch eine europäische Richtlinie aus dem Jahr 2019 ((EU) 2019/1023) in Frage gestellt, die eine relative Vorrangregel als Alternative zur absoluten Vorrangregel vorsieht. Der Verfasser analysiert beide Regeln und die im Jahr 2021 mit dem SanInsFoG in Kraft getretenen neuen Ausnahmen von der absoluten Vorrangregel in § 245 InsO sowie in § 27 f. StaRUG.
»Absolute or Relative Priority of Creditor Classes in Restructuring Law«: The absolute priority rule has been called »bankruptcy’s most important and famous rule«. Yet, a European directive from 2019 ((EU) 2019/1023) has challenged this status and introduced a so called relative priority rule. Following a historical, comparative and economic legal analysis, the thesis evaluates both rules and the new exceptions to the absolute priority rule that were introduced into German restructuring law in 2021 (§ 245 InsO and § 27 f. StaRUG).
