Beschreibung

Bei Völkerstrafprozessen stehen dem Internationalen Strafgerichtshof (IStGH) und nationalen Strafgerichten unterschiedlich konzipierte Verfahrensrechte zur Verfügung, doch steht das gleiche Ziel im Mittelpunkt: ein fairer Prozess. Das erste in Deutschland abgeschlossene Völkerstrafverfahren wird einem Verfahren vor dem IStGH gegenübergestellt. Dabei zeigt sich, dass auf beiden Ebenen faire Prozesse möglich sind. Eine verlässliche Rechtstradition ist jedoch erst noch im Entstehen.

The first international criminal trial concluded in Germany is contrasted with a trial before the ICC in The Hague. It is shown that it is feasible in both jurisdictions to have a fair trial. But a reliable legal tradition is still in the making.
