Die rasante Entwicklung des Online-Vertriebs schafft neue rechtliche Herausforderungen. Kern der Arbeit ist die kartellrechtliche Einordnung diverser Internetvertriebsgestaltungen wie Internetvertriebsverbote, qualitative/quantitative Vorgaben, Doppelpreissysteme, Plattformverbote, Preisparitäts- und Bestpreisklauseln. Zudem wird beleuchtet, ob das Kartellrecht an die sog. Distributionsrevolution angepasst werden muss, ein Paradigmenwechsel stattfinden muss oder ein Sonderkartellrecht nötig ist.

The fast development of the online retail channel has created various new legal challenges. This paper focuses on the competitive assessment of online distribution clauses, such as a total ban, qualitative/quantitative requirements, dual pricing, prohibitions of platforms, price parities and best price clauses.The paper additionally addresses whether the competition law has to be adjusted, if a special antitrust law has to be developed or a shift of paradigms in competition law has to take place.
