Beschreibung

Das Staatsrecht wie die es legitimierende Staatslehre in Deutschland sind bisher noch immer weithin getragen durch Anerkennung, Schutz, Ausgestaltung »transpersonaler« gesellschaftlich-politischer Kräfte in Grundentscheidungen der Verfassung: Religion, Familie, Staatsgewalt (Machtstaatlichkeit), neuerdings Ökonomie. Doch das Grundgesetz fordert, und es zeigt bereits einen neuen individualethischen Personalismus als Rechtfertigung und Grundlage seiner Demokratie. Dies wird dort entfaltet in Grundentscheidungen und grundrechtlichen wie staatsorganisatorischen Gestaltungen.
»Individual Ethics and Democratic State« Theory of the State and Constitutional Law were in Germany traditionally based on Legal Thinking in forms of a »Transpersonalstic Concept« of the State: Religious convictions, social structures in forms of Family Life, but primarily Organisations of Power-Politics furnished categories dominated evolutions. Contemporary Democracy is organized in the German Basic Law (Grundgesetz) in constitutional Rules founded on individual Ethics, personal convictions. More than Legal Protection – a space for evolution has to be given to this in a new general concept of »Personalistic Constitutional Law«.
