Due to its networking with other franchise contracts, German and Dutch law are unable to incorporate the franchise contract sufficiently into the legal contract types and the general rules. Annika Schimansky deals with the network-contract-model approach, an approach which is presently under discussion in German jurisprudence, and with the model of the connected legal relationships which originated parallel to this in the Netherlands.
She examines their close connection with the recognition that the franchise system can be subjected to trust law. From the standpoint of the law of contract or trust law, she deals with the question of the liability of the franchisor as 'manager' in the franchise system and with the claims made by the franchisee upon termination of the contract.
