In this textbook, excerpts from 12 German appellate decisions are analysed by Hein Kötz and Hans-Bernd Schäfer from a legal and economic perspective. The authors wish to show what contribution economic analysis can make to solve practical cases in a way which is both efficient and consistent with the wording of the applicable statue.

The authors wish to show what contribution economic analysis can make to solve practical cases in a way which is both efficient and consistent with the wording of the applicable statue. It turns out that while the results reached in some decisions withstand economic criticism, the results of other cases do not.
